OFFICIAL RULES
ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. The Kansas City Race Sweepstakes (the "Sweepstakes") is open to legal residents of the United States (excluding where prohibited by law, rule or regulation), who are 18 years or older at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Fan1st.com (the "Sponsor"), their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: The Sweepstakes begins on Friday, March 10, 2007 and ends on September 1, 2007 ("Entry Period"). There are two ways to enter: online at Fan1st.com or via mail. No other method of entry will be accepted. Limit one entry per person regardless of method of entry.
1. Online Method: During the Entry Period go to www. Fan1st.com and click on the Sweepstakes banners, buttons and/or links to access the online entry form for the Sweepstakes. By submitting your complete name, address, city, state, ZIP/postal code, country of residence, telephone number, fax number (optional), and e-mail address via the online entry form, you will be automatically entered in the Sweepstakes. All information submitted by entrants is subject to the Fan1st Privacy Policy accessible at: https://store.fan1st.com/index.php?main_page=privacy&zenid=51aa453b66e6588f9e2456f38ebd06fa. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void.
2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by printing your name, address, city, state and zip code, day & evening telephone number and email address (optional) on a standard size postcard. Sponsor will only use email addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's provision of this information. Mail-in entries must be postmarked by September 1, 2007 and received by Sponsor by September 8, 2007. Mail-in entries become the property of the Sponsor and will not be returned.
RANDOM DRAWING: The winner of the Sweepstakes (the "Winner") will be selected by random drawing on or about September 12, 2007 from all eligible entries received by the Sponsor. The decisions of Sponsor, including the selection of Winners, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one prize per person, family or household.
PRIZES: One (1) prize will be awarded. The Winner will receive two (2) seats at the September 29, 2007 Kansas Speedway Yellow Transportation NASCAR Busch Series event, including roundtrip airfare and accommodations. Roundtrip airfare will be coach transportation from a major airport close to the Winner's residence to Kansas City, as determined by the Sponsor, and return trip. Roundtrip airfare consists of transportation on the carrier of Sponsor's choice departing Thursday, 9/27/07 and returning Sunday, 9/30/07. The Sponsor cannot be held liable for any delays or disruptions experienced during travel. The Sponsor will choose the hotel for the 1 room, 2 night lodging, and this selection is non-negotiable. All details of the Prize (including arrangements, date, time and location) shall be determined by Fan1st.com in its sole discretion and the Sponsor reserves the right to make changes. The Winner is fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to the Prize, including but not limited to lodging, roundtrip airfare, and tickets (including income taxes) and gratuities and other expenses incurred by accepting the prize are the sole responsibility of the Winner. Winner's companion must be 18 years of age or older, unless traveling with a parent or guardian. Race dates and times are determined in the sole discretion of The National Association for Stock Car Auto Racing, Inc. (NASCAR), as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a race is not conducted due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Sponsor and NASCAR Entities reserve the right to remove or to deny entry to the winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with an intent to annoy, abuse, threaten, or harass any other person at the event.
The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor's sole discretion. NASCAR and Sponsor will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of the event. There will be no substitutions for the Prize.
NOTIFICATION: The Winner will be notified by e-mail and/or telephone by the Sponsor, or in the event the Winner entered by regular mail, he or she may be notified by telephone by the Sponsor. In the event that the Winner does not respond to any such notification within twenty-four (24) hours, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The Winner will receive Sponsor's Affidavit of Eligibility and Release of Liability, which must be completed, notarized and returned within seven (7) days of receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if the Sponsor's Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of Sponsor's Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, each Winner agrees to waive any and all claims against the Sponsor, NASCAR and their respective agents and representatives for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize, and each Winner grants to Sponsor and NASCAR the right to publicize such Winner's name and/or likeness in any medium without additional compensation or consideration unless prohibited by law.
GENERAL CONDITIONS: The Sponsor, their agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Sponsor, their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion.
Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor and their agents. Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Sponsor (i) makes no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaims any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of Clark, State of Nevada.
Sponsor reserves the right, in their sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Sponsor corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
